Greg Wagner represents and advises clients in the oil, natural gas and electricity industries in regulatory, litigation and transactional matters. He represents oil and natural gas shippers and pipeline owners, gas marketers, electric utilities and power marketers before the Federal Energy Regulatory Commission, state regulatory commissions and the United States Courts of Appeals.

Mr. Wagner advises clients that own crude oil and refined products pipelines regarding compliance with FERC regulations and represents such companies before the FERC. He assists both pipeline owners and potential shippers in contracting for transportation service and pipeline connections, and advises pipelines and shippers regarding FERC’s open season and ratemaking policies. He has extensive experience litigating pipeline rate matters before FERC, the California Public Utilities Commission and state and federal courts. Mr. Wagner also advises natural gas and liquids pipelines regarding the Department of Transportation’s pipeline safety requirements.

He assists natural gas pipelines and marketers in complying with FERC regulations and requirements, including structuring and negotiating capacity release and asset management transactions. Mr. Wagner also assists regulated entities with internal investigations of compliance with FERC regulations and policies.

On the electric side, Mr. Wagner represents clients as to both cost-based and market-based rate applications, as well as market power analyses, tariff amendments and merger and transfer applications. He advises electric utilities and power marketers on compliance with FERC regulations and requirements with respect to market-based rate authority, the Public Utility Holding Company Act of 2005 and qualifying facility requirements under the Public Utility Regulatory Policies Act. He has extensive experience litigating FERC enforcement matters and representing companies in the investigative process.

Mr. Wagner advises clients regarding compliance with the Commodity Futures Trading Commission’s regulations implementing the Dodd-Frank Wall Street Reform and Consumer Protection Act, including data reporting and recordkeeping requirements, and helps clients structure and negotiate commodity transactions and derivatives to minimize regulatory burdens while complying with CFTC requirements.
